Police Scotland require to complete a form requesting the disclosure of information from external organisations.
The form is used by police by means of making a formal request to organisations for personal data where disclosure is necessary for the purposes of the prevention or detection of crime or the apprehension or prosecution of offenders. It was referred to a section 29 Notice under the previous legislation and is now required in terms of Schedule 2 Part 1 Paragraph 2 of the Data Protection Act 2018 and GDPR Article 6(1)(d). In addition to setting out the information required, the form should also confirm that the individual concerned should not be informed of the request as it would prejudice the investigation. In this case, the police would require to set out the various spellings of the individual’s surname for you to progress the request effectively.
While the request does not compel the Council to disclose the information, it provides reassurance that the disclosure is appropriate.
